[letterhead]Home.Feb. 22, 1909Dear Muir:I think we must now work for a re[illegible]tion of the Garfield grant by the new administration. I know the new attorney [illegible]. Mr. Wickerhaw and shall see him to-morrow. The new Secy. of the Interior, R. A Ballinger, hails from Seattle. The Phelan crowd will of course try to c[illegible] him. His address as give[n?] in "Who's Who for 1907" is Alaska Building Seattle. It might be well to say to him - for you to say to him - that the question will probably come04445 before him early in his in[illegible]bency and that we hope to present to him such conclusive arguments as to justify him in following the pre[illegible] of ex-Secretary Hitchcock and not that of Secretary Garfield ex-Secretary Noble being also on our side.I shall see Wickerhaw tomorrow, if not today.Reed Smoo[illegible], of the Senate Committee [on?] R[illegible] Lands writes me that in his judgment the resolution will not be [illegible]ed by the Committee at this session. I am on good terms with him & with Newlands, both able sand influential senators.A story point I am making is that an Act of Congress with a definite purpose cannot be nullified by an administrative that passed later. You see that [Whitman?] [illegible]ed this point admirably before the House Com. John Sharp Williams takes the views that the Garfield grant is legislation.
