California Supreme Court: Defining the Boundaries

Abstract
The law is full of fine distinctions, and being able to recognize those distinctions — to grasp where the boundaries are — is the common law lawyer’s stock in trade. This year’s decisions from the California Supreme Court involved an unusually large number of cases where the issue could fairly be framed as “A” or “B,” with the court’s opinion defining the boundary between those two choices.
